What is a partner visa?

If you are in a relationship with an Australian citizen or permanent resident, and want to live in Australia with your partner, you may apply for a partner visa. Your relationship will be assessed carefully and rigorously to determine whether the requirements for a partner visa are met.

What are the requirements for a partner visa?

To apply for a partner visa, the applicant must be either the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen. De factor relationships are those which commenced at least one year prior to the date of the partner visa application, have not been interrupted, and which are serious / genuine. Each person must be over the age of 18.

There are different partner visa subclasses depending on whether the applicant is in Australia or outside Australia at the time of application:

  • If the partner visa applicant is in Australia, they need to apply for the subclass 820 – 801 partner visa
  • If the partner visa applicant is outside Australia, they need to apply for the subclass 309 – 100 partner visa

What are the benefits of a partner visa?

Partner visa permit the holder to live, work and study in Australia. Partner visa holders are also eligible to apply for medicare and other benefits such as centrelink and child support. The partner visa holder is permitted to enter and leave Australia as often as they wish. The initial partner visa is valid for 5 years and partners can apply to stay after this timeframe.

What are the processing times for a partner visa application?

A partner visa application can take a significant amount of time for the Department of Immigration and Border Protection to process (currently 12 – 15 months) due to the stringent checks that are applied.

What do you need to provide in order to apply for a partner visa?

The partner visa application process can be quite bureaucratic and cumbersome. You will need to send substantial supporting evidence including:

  • Passports
  • Statements about your relationship
  • Official documents proving your relationship
  • Other supporting evidence to demonstrate that your relationship is genuine e.g. joint bills, joint ownership of assets, statutory declarations from third parties etc
  • Health examinations
